PRIVACY POLICY

This policy describes the ways the Oregon State Bar Professional Liability Fund ("PLF") collects, stores, uses and protects the personal information of PLF Plan members and other users accessing or using any part of the PLF website and any other digital services operated or used by the PLF from time to time (collectively referred to as the "Site"). You accept this Privacy Policy when you view or login to the Site and/or use any services or other features, technologies or functionalities offered by the PLF. The PLF may amend this policy at any time by posting a revised version on our Site. The revised version will be effective at the time we post it.
HOW WE PROTECT AND STORE PERSONAL INFORMATION
Throughout this policy, we use the term “personal information” to describe information that can be associated with a specific person and can be used to identify that person.
The PLF Site uses reasonable, appropriate, and customary procedures and technologies to help protect the confidentiality of any Personal Information collected through the Site and has security measures in place that seek to mitigate risk. However, no website can be absolutely protected against intentional or malicious intrusion attempts despite our precautions. Furthermore, PLF does not control the devices, computer or network through which you access the Site or over which you may choose to send personal information to the Site, and therefore cannot prevent potential interceptions or compromises to your information while in transit to the Site. PLF makes no guarantee as to the security, integrity or confidentiality of any information transmitted to or from the Site. PLF is committed to safeguarding your information to the best of its ability but cannot guarantee the security of electronic communications or transmissions made over the Internet.
We store your information on our local servers in Oregon and Pennsylvania and systems maintained by our third party cloud-based data hosting providers. We protect your personal information by maintaining physical, electronic, and procedural safeguards in compliance with applicable United States federal and state regulations. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities. Only authorized employees, agents, and contractors (who have agreed to keep information secure and confidential) have access to this information. We do not transfer your information to locations outside of the United States. This information may be subject to access requests from governments, courts, law enforcement officials and national security authorities in the United States according to its laws. Subject to the applicable laws, we will use reasonable efforts to ensure that appropriate protections are in place to maintain protections on the personal information.
If we opt to transfer your information to a location outside of the United States, we will update this Privacy Policy accordingly.
PLF may retain your personal information for as long as necessary for the purposes described in this Privacy Policy. We will retain and use your personal information to the extent necessary to provide our services to you, comply with our legal obligations (for example, if we are required to retain your information in accordance with applicable laws), resolve disputes and enforce our legal agreements and policies. We will also retain Site usage data for internal analysis purposes. Site usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our services, or we are legally obligated to retain this data for longer periods.
Access to the member section of the Site and the excess coverage section of the site are protected by password. We recommend that you not divulge your passwords to anyone.
INFORMATION COLLECTED BY US
Personal Information
The personal information collected from you through the Site may include the following when provided by you via the member or excess coverage sections of the Site, when you login to PLF via the Oregon State Bar website, register for an event, place an order, apply for excess coverage, or sign up to receive communications from us:

Tracking and Cookies Data
Session Cookies: When you visit the Site, session cookies are maintained in your computer's temporary memory. These disappear when your session is over and you close your browser. Session cookies allow users to be recognized within the Site so user data and selections are remembered within the Site.
Server Log information: When you visit this Site, the PLF collects information sent to us by your computer, mobile phone or other access device. This information may include your IP address, device information including but not limited to identifier, name and type, operating system, location, mobile network information and standard web log information, such as your browser type, traffic to and from our site and the pages you accessed on our website. Your IP address is automatically collected in server logs. We use this information to help diagnose problems with our server, to analyze server traffic to learn which pages on the Site receive more or fewer visitors and for fraud prevention purposes. This information is anonymous and cannot be traced back to a specific individual. The server log also can tell us which browser you are using and the name of the Site that referred you to our site.
Excess Coverage Section of Site: Members of the Oregon State Bar are able to login to the Excess Coverage section of the Site. This section of the Site is protected by a password and users who access this portion of the Site must agree to a Supplemental Privacy Policy specific to that portion of the Site.
HOW WE USE THE INFORMATION WE COLLECT
Our primary purpose in collecting personal information is to provide you with a secure, smooth, efficient experience and to ensure that only members of the Oregon State Bar and employees and agents of the PLF have access to the Site. We may use your personal information to:

Fulfill your requests;

Process insurance requests and/or payments;

Facilitate your movement through the Site;

Provide any customer support or services you request;

Process any orders for Practice Management Materials, CLE or other products or services offered on the Site;

Communicate with you as required by the terms of your law license;

Send you blogs if you opt into our subscription lists;

Prevent potentially prohibited or illegal activities, and enforce our User Agreement;

Collect data on overall website usage to guide future enhancements.
If you login to the section of the website related to the PLF’s Excess Plan, you must agree to a Supplemental Privacy Policy specific to that portion of the Site, which explains the use of information submitted on that portion of the site in more detail.
MARKETING
We don’t sell, rent, or disclose your personal information to third parties for their marketing purposes at any time.
HOW WE SHARE PERSONAL INFORMATION WITH OTHER PARTIES
We may share your personal information with employees and agents of the PLF for the purpose of fulfilling orders and processing requests you may make on this Site, and providing you with services as required by the terms of your law license. If you login to the section of the website related to the PLF’s Excess Plan, you must agree to a Supplemental Privacy Policy specific to that portion of the Site, which explains how your personal information is used on that portion of the site in more detail.
We do not share your personal information or any data regarding your access or use of the Site or the PLF Content with the Oregon State Bar. The only exception to this rule is that, if you sign up for a CLE program offered on this Site, pursuant to MCLE Rules 4.2(c)(3) and 7.150, the PLF will provide reports and attendance records reflecting your purchase of CLE materials offered by the PLF or your participation or viewing of CLE programs offered by the PLF to the Oregon State Bar.
We may share your information with law enforcement, government officials, or other third parties when 1) we are compelled to do so by a subpoena, court order or similar legal procedure, 2) we believe in good faith that the disclosure of personal information is necessary to investigate violations of our User Agreement.
We may also share your information if you consent and direct us to do so and such direction does not violate our User Agreement.
EMAIL PRIVACY AND MEMBER CONTACT INFORMATION
From time to time, the PLF sends broadcast email to PLF Claims Made Plan and/or Excess Plan Members. We may use pixel tags to track the success of emails sent to users, but we do not share that information with third parties. Recipients of broadcast email communications from the PLF regarding CLEs, publications, and other practice management services do have the ability to opt out of such communication. Email communications sent from the PLF regarding member assessment and exemption notices do not have the ability to opt out as those communications are required by the terms of your law license.
LINKED SITES
The Site contains links to other external websites (“Linked Sites”) that we believe may be useful to PLF Claims Made Plan members, Excess Plan members and the public. The PLF is not responsible for the privacy practices or the content of these Linked Sites. Please see PLF Website Terms of Use for more information.
THIRD PARTY SERVICE PROVIDERS
The PLF may use third party service providers to help us analyze certain online activities, measure the performance of the PLF Site, and monitor the effectiveness of email communications. For example, these service providers may help us analyze visitor activity on the PLF Site or provide feedback on the effectiveness of our email communications. We may use a third party service provider to help us efficiently send email communications to PLF Claims Made Plan and Excess Plan members. Aside from member email addresses, we do not share any personal information about members with third party service providers. Our third party service providers are prohibited from sharing, selling or renting member email addresses.
CHILDREN
The intended audience of our Site is adults over the age of 18. PLF does not knowingly solicit data online from or market online to children under the age of 13. In certain circumstances, a minor could submit a claim via the Site or other means.
If you are under 18 years of age, do not attempt to register for or use any of our services, including our Site, do not provide us any personal information about yourself unless you have the requisite parental consent. If you are a parent or guardian and you are aware that your child has violated this Privacy Policy and provided us with personal information, please contact us as described below. If we become aware that a minor has provided us personal information or otherwise used our services in violation of the Policy, we will take steps to remove that information.
To request the removal of information about a minor from this Site, parents or guardians may submit a request via the contact information listed below. If you are making this request by email, include the subject line “Removal of Minor Information.” Such requests must come from the minor’s parents or guardian; minors may not submit information to us via email.
Our Policy on “Do Not Track” Signals
We do not support Do Not Track. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable “Do Not Track” by visiting the “Preferences” or “Settings” page of your web browser.
PLF does not track users across time and over different websites or platforms.
Click Through to Oregon State Bar Website: In some areas of the Site, there are "click-through URLs" which take the user directly to the Oregon State Bar Web Site. When a user clicks on one of these URLs, they pass through a separate web server before arriving at the destination page on the Oregon State Bar Site. Although the PLF does not track this click-through data, the Oregon State Bar may track this data in accordance with its Privacy Policy which can be located at http://www.osbar.org/privacypolicy.html.
Third parties may collect data that relates to you. We cannot control third parties’ responses to do-not-track signals or other such mechanisms. Third parties’ use of data relating to you and responsiveness to do-not-track signals is governed by their respective privacy policies.
